Terms of service

These terms are between you ("you," "your") and AutoMarketer ("we," "us," "our"), the company operating AutoMarketer.com. By using AutoMarketer you agree to these terms. If you are using AutoMarketer on behalf of a business, you represent that you have authority to bind that business to these terms.

AutoMarketer is an AI-powered marketing automation platform. You provide a website URL; the service analyzes the site, builds a Brand Profile, and generates marketing assets (articles, ads, social posts, emails) across multiple channels on a recurring autopilot schedule. On the Connections page you can mark a channel as connected by recording which of your own accounts (Google Ads, Meta, Microsoft Advertising, social platforms, CMSs, and ESPs) it belongs to. No login, password or access token is requested or stored for that.

You are responsible for keeping your login credentials secure. You are also responsible for all activity under your account. If you suspect unauthorized access, contact us immediately at support@automarketer.com. We may suspend or terminate accounts that we believe are being used fraudulently or in violation of these terms.

You must be at least 18 years old and capable of entering into a legally binding agreement to use AutoMarketer.

Paid plans are billed monthly or annually in advance through our payment processor. Annual plans are billed as a single charge for the year. Monthly plans renew each calendar month on the date you first subscribed. Prices are listed on the Pricing page and in your account.

You may cancel your subscription at any time from your billing page. Cancellation stops future billing. You retain access to your current plan through the end of the paid period. Unused days of a billing period are not refunded.

Renewals and failed payments. Your subscription renews automatically until you cancel it. When a new billing period begins, access for that whole period is granted and the payment for it is due. If the charge does not go through, the payment remains due and we retry it. Cancelling after a new period has begun only switches off later renewals; it does not cancel the payment for the period that has already started. Such a renewal charge is not refundable, and your access continues until the end of that paid period. The fee is for access to the service for the period, not for using it, so not having used the service is not a ground for a refund.

All payments are final. The narrow cases in which we return a charge, and how to ask for a review, are set out in our Refund Policy, which forms part of these terms.

Each plan has a monthly asset generation limit. Agency plans are subject to fair use: the autopilot loop is designed for real business marketing. Automated bulk generation for purposes other than marketing the sites associated with your account is not permitted. We reserve the right to throttle or suspend accounts that exceed fair use.

You retain all rights to your website, your brand, and your marketing assets. The content AutoMarketer generates belongs to you once generated. You grant us a limited license to store, process, and transmit that content in order to provide the service.

You are responsible for reviewing generated content before you export it and publish or send it from your own accounts. We are not responsible for the accuracy, quality, or compliance of AI-generated content that you choose to publish. Co-pilot mode exists specifically to give you a review step, and because AutoMarketer publishes nothing itself, the final step is always yours.

AutoMarketer writes ad copy, campaign structures and keyword plans, and exports them for you to import into your own ad accounts. It does not create, modify or run campaigns on your behalf, does not connect to Google Ads, Microsoft Advertising or Meta Ads, and never spends your budget. Everything you import and run on those platforms is yours to configure and pay for, and you are responsible for all charges incurred on your own ad accounts.

You may not use AutoMarketer to:

• Generate or publish spam, deceptive, misleading, or illegal advertising
• Violate the advertising policies of Google, Meta, Microsoft, or any connected platform
• Market products or services that are illegal in your jurisdiction or the target audience's jurisdiction
• Collect or process personal data in ways that violate applicable privacy laws (GDPR, CCPA, etc.)
• Reverse engineer, scrape, or extract data from the AutoMarketer platform
• Resell or redistribute access to AutoMarketer without explicit written permission

We aim for 99.5% uptime but do not guarantee uninterrupted service. Autopilot cycles may be delayed during maintenance windows or infrastructure issues. We will not credit or refund for downtime of less than 24 hours per month. If we fail to run your autopilot cycle for more than 72 consecutive hours due to our infrastructure, contact support for a credit.

To the maximum extent permitted by law, AutoMarketer is not liable for indirect, incidental, consequential, or punitive damages, including lost revenue or lost profits. Our total liability for any claim arising from your use of the service is limited to the amount you paid us in the three months preceding the claim. This applies even if we have been advised of the possibility of such damages.

The service is provided "as is." We make no warranty that the AI-generated content will be accurate, suitable for any particular purpose, or free from errors. Marketing results (traffic, conversions, ROAS) depend on many factors outside our control and we cannot guarantee specific outcomes.

We may update these terms. We will notify you by email at least 14 days before material changes take effect. Continued use of AutoMarketer after the effective date constitutes acceptance. If you disagree with the updated terms, you may cancel before the change takes effect.

These terms are governed by the laws of the jurisdiction where AutoMarketer is incorporated, without regard to conflict-of-law provisions. Disputes will be resolved by binding arbitration where applicable law permits.
